1. Purpose
This Acceptable Use Policy (“AUP”) describes acceptable and prohibited uses of Onsharp's hosted products and services, including Onsharp Core, Onsharp Connect, Onsharp hosting services, and any related websites, applications, and platforms (collectively, the “Services”).
The purpose of this AUP is to protect Onsharp, our customers, and the public by ensuring the Services are used responsibly, securely, and in compliance with applicable laws.
2. Applicability
This AUP applies to:
- all Customers of the Services; and
- all individuals and entities that Customer permits to access or use the Services, including Customer's employees, contractors, agents, and end users (“Authorized Users”).
Customer is responsible for ensuring that its Authorized Users comply with this AUP.
3. Changes to this AUP
Onsharp may modify this AUP from time to time. If we make changes, we will post the updated AUP on our website. Customer's continued use of the Services after changes become effective constitutes acceptance of the updated AUP.
4. Prohibited Uses
Customer may not use, and may not permit any Authorized User to use, the Services to engage in any activity that is illegal, harmful, abusive, or that interferes with the integrity, security, or availability of the Services.
The following are examples of prohibited uses. This list is not exhaustive.
4.1 Unlawful Activities
The Services may not be used in violation of any applicable local, state, provincial, federal, national, or international law, regulation, treaty, court order, ordinance, or administrative rule.
Prohibited unlawful activity includes, without limitation:
- child sexual abuse material (“CSAM”) / child pornography
- unlawful gambling activities
- threats, harassment, or abuse
- fraudulent activities
- terrorist content or advocacy of violence or hate crimes
- Ponzi schemes or unlawful high-yield investment programs
4.2 Child Sexual Abuse Material (CSAM)
The Services may not be used to publish, submit, receive, upload, download, post, transmit, distribute, store, or otherwise make available child sexual abuse material (CSAM) or child pornography.
4.3 Spam and Unsolicited Messaging
The Services may not be used to send or facilitate the sending of mass unsolicited messages, including “spam,” unsolicited commercial email, or bulk marketing messages in violation of applicable law.
This includes:
- falsifying sender identity, headers, or routing information
- email bombing or flooding
- using the Services as a proxy email server to forward email to unrelated parties
- UseNet spam or abuse
4.4 Unauthorized Access, Security Testing, or Exploitation
Customer may not attempt to access, probe, scan, test, breach, circumvent, or exploit the authentication or security of any system, network, server, device, software, or data without authorization.
This includes, without limitation:
- attempting to gain access to accounts, data, or systems not belonging to Customer
- bypassing security controls, rate limits, or access restrictions
- attempting to obtain credentials, tokens, or API keys without authorization
4.5 Harmful, Threatening, or Abusive Content
Customer may not use the Services to host, post, transmit, or distribute content that threatens, harasses, abuses, or harms others.
Onsharp reserves the right to refuse or discontinue Services if content is determined by Onsharp (in its reasonable discretion) to be obscene, indecent, hateful, malicious, racist, defamatory, fraudulent, excessively violent, or otherwise harmful.
4.6 Intellectual Property Infringement
Customer may not use the Services to upload, store, transmit, or distribute content that infringes or violates any intellectual property, privacy, or publicity rights of Onsharp or any third party.
4.7 Malware, Viruses, and Malicious Code
Customer may not use the Services to store, distribute, fabricate, or use malware or malicious software, including viruses, rootkits, password crackers, adware, keyloggers, or other tools used for malicious activity.
4.8 Phishing and Identity Theft
Customer may not use the Services for phishing or any activity designed to collect personal information under false pretenses (including usernames, passwords, account numbers, or other sensitive data).
4.9 Denial of Service / Service Disruption
Customer may not use the Services to initiate, facilitate, or participate in denial-of-service (“DoS”) or distributed denial-of-service (“DDoS”) attacks.
Customer may not use the Services to perform DoS/DDoS mitigation activities (such as proxying or scrubbing) that may attract inbound denial-of-service attacks toward the Services.
4.10 Violation of Third-Party Agreements
Customer may not use the Services in any manner that violates any third-party agreements applicable to Customer.
5. SaaS-Specific Restrictions (Core + Connect)
In addition to the prohibited uses above, Customer may not:
- share accounts or credentials between multiple individuals except as permitted by Customer's subscription plan
- use the Services to build a competing product or service
- scrape, crawl, harvest, or extract data from the Services (including through automated means) except as expressly permitted by the Services or in writing by Onsharp
- attempt to reverse engineer, decompile, or discover source code or underlying algorithms of the Services (except to the extent prohibited by law)
- use the Services in a manner that interferes with platform performance or security (including excessive API calls, automated abuse, or bypassing rate limits)
6. Reporting Violations
Onsharp accepts reports of alleged violations of this AUP via email to legal@onsharp.com.
Reports must include:
- name and contact information of the reporting party
- the relevant account, website, or IP address (if applicable)
- a description of the alleged violation
- any supporting evidence reasonably available
Onsharp will review verified reports and may take action in its sole discretion.
7. Legal Process
Onsharp will comply with valid subpoenas, warrants, and court orders as determined by Onsharp in its sole discretion.
If permitted by law, Onsharp may forward such legal requests to Customer for response; however, Onsharp reserves the right to respond directly if it is the named party.
8. Enforcement
Onsharp may investigate suspected violations of this AUP and may suspend or terminate access to the Services for violations, including repeated or excessive violations.
Onsharp retains the right, at its sole discretion, to refuse new service to any individual, group, or business.
